CAADS ALERT: New DDS Directive: Providing and Claiming for Nonresidential Services during COVID-19

JULY 23, 2020 | California Association for Adult Day Services (CAADS) | ALERT

On July 17, 2020, the Department of Developmental Services (DDS) issued a new directive that extends the expiration date for "absence billings" for non-residential services to August 31, 2020. Those billings were set to expire on July 31, 2020. The directive also includes a framework for the delivery of alternative services for those non-residential services that would go into effect September 1, 2020, that, prior to the State of Emergency due to COVID-19, were provided in site-based programs.

What the new directive does:
ABSENCE BILLINGS: Extends the "absence billings" to nonresidential providers for consumer absences through August 31, 2020.

The Long Term Care at Home (“LTC at Home”) Proposal was first released as a “trailer bill” proposal in May and then introduced to stakeholders by the California Department of Health Care Services (DHCS) in June 2020. Development of this new statewide Medi-Cal benefit is currently being fast tracked, with implementation planned for early 2021, pending CMS approval.

The medical care and home and community-based services (HCBS) to be provided through this proposed benefit would be determined by conducting person-centered assessments. While the proposal indicates that services will be tailored to individual needs, it is not clear what these services will entail nor whether this will include 24-hour health care and support as skilled nursing facilities do, as the full range of services available through this benefit has not been described.

To: REGIONAL CENTER EXECUTIVE DIRECTORS

As follow up to the Department of Developmental Services’ (Department) June 18, 2020 guidance, the purpose of this correspondence is to extend retention payments to nonresidential providers for consumer absences through August 31, 2020

In addition, this correspondence previews the structure for subsequent reimbursement of claims for providing nonresidential services using alternative service delivery approaches during the COVID-19 State of Emergency. The structure described would have an effective date of September 1, 2020, pending the issuance of an additional directive by the Department. The procedure outlined in this correspondence is a step toward reimagined service delivery, reflecting modifications that may be necessary during the COVID-19 pandemic. These modifications are driven by the Department’s priority to maintain federal funding and its intent that services be provided to regional center consumers based on consumer preferences.

CDC Updates Public Data Portal on the Health of Older Adults

The CDC recently updated the Alzheimer’s Disease and Healthy Aging Data Portal, which provides access to a range of national, regional, and state data on older adults. This resource allows users to examine data on key indicators of health and well-being for older Americans, including caregiving and cognitive decline, by age group, gender, and race/ethnicity.

The Portal was updated with 2018 BRFSS data, including data on cognitive decline from 50 states and data on caregivers from 44 states. Portal users can retrieve CDC data by indicator or by geographic area, and then use these data to develop reports and create customized maps, charts, and graphics.

Public health professionals can use the data to create a snapshot of the health of older adults in their states, which can help them prioritize and evaluate public health interventions.

  • This AFL notifies all facilities of updated visitor guidelines for pediatric patients, patients in labor and delivery, neonatal intensive care unit (NICU) patients, pediatric intensive care unit patients (PICU) patients, and patients at end-of-life and patients with physical, intellectual, and/or developmental disabilities and patients with cognitive impairments.
  • Health facilities may permit a support person to accompany a patient for whom a support person has been determined to be essential to the care of the patient (medically necessary), including patients with physical, intellectual, and/or developmental disabilities and patients with cognitive impairments.
  • This AFL has been updated to clarify that long-term care facilities and hospitals may permit students obtaining their clinical experience as part of an approved nurse assistant, vocational nurse, or registered nurse training program into the facility if they meet the CDC guidelines for healthcare workers.

Summary
COVID-19 transmission rates continue to rise across the state, including increasing numbers of cases in rural counties that had not previously experienced significant infection rates. Despite the closure of certain indoor sectors in counties on the County Monitoring list, those counties continue to demonstrate concerning levels of disease transmission that impact not only the general population but vulnerable populations in the community.

This guidance and the Statewide Public Health Officer Order, dated July 13, 2020:

  • Closes, on a statewide basis, indoor operations for certain sectors, and both indoor and outdoor operations for bars and similar establishments, consistent with the June 28 and July 1 restrictions on counties on the County Monitoring List.
  • Closes, for counties on the County Monitoring List for three or more consecutive days, indoor operations for additional sectors which promote the mixing of populations beyond households and make adherence to physical distancing with face coverings difficult. Within these sectors, and in the affected counties, those specified businesses that are not able to continue their business through outdoor operations must close that portion of their business effective immediately in order to further mitigate the spread of the virus.
